Buzz Capitol respects the intellectual property rights of others and expects the same from those who use our site. This DMCA Policy explains how we handle claims of copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
1. Reporting Copyright Infringement
If you believe that content posted on Buzz Capitol infringes your copyright, you may submit a takedown notice in accordance with the DMCA.
To be considered valid, your notice must include all of the following:
- Your full legal name and contact information (address, phone number, and email)
- A description of the copyrighted work you believe has been infringed
- The specific URL(s) where the allegedly infringing content appears on our site
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
- Your physical or electronic signature

3. Our Response to a Valid Notice
Upon receiving a complete and valid DMCA notice, we will:
- Acknowledge receipt of the notice
- Conduct a timely review of the claim
- Remove or disable access to the content in question if the claim appears valid
- Notify the user who posted the content that it has been removed
- Keep a record of the notice and our response
We aim to act on valid DMCA notices within 5–10 business days.
4. Counter-Notification
If you believe content you posted was removed in error or due to misidentification, you may submit a counter-notification. Your counter-notice must include:
- Your full legal name and contact information
- Identification of the content that was removed and the URL where it previously appeared
- A statement, made under penalty of perjury, that you have a good-faith belief the content was removed due to mistake or misidentification
- A statement consenting to the jurisdiction of the federal district court for the judicial district where your address is located
- Your physical or electronic signature

5. Repeat Infringers
In accordance with the DMCA, Buzz Capitol maintains a policy of taking appropriate action, including termination of contributor access, against those who repeatedly infringe on the copyrights of others.
6. Misuse of the DMCA Process
Submitting false or fraudulent information in a DMCA notice is a serious matter. Under Section 512(f) of the DMCA, anyone who knowingly makes a material misrepresentation regarding infringing material may be held liable for damages, including costs and attorneys’ fees.
7. Fair Use
Buzz Capitol recognizes and complies with the “fair use” doctrine under 17 U.S.C. § 107. Excerpts of copyrighted content may be protected under fair use when used for commentary, criticism, news reporting, teaching, or research. Any removal requests are carefully reviewed with fair use considerations in mind.
